Welcome to Big Valley Properties. By accessing or using our website at bigvalleyproperties.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree with these Terms, please do not use the Site.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to use the Site in any way that:

  • Violates any applicable local, state, national, or international law or regulation.
  • Is fraudulent, deceptive, or misleading.
  • Infringes on the intellectual property rights of Big Valley Properties or any third party.
  • Transmits spam, unsolicited messages, or harmful software.

2. Real Estate Services

Big Valley Properties is a licensed real estate brokerage serving Trinity and Shasta Counties, California. Information on this Site is provided for general informational purposes and does not constitute legal, financial, or professional real estate advice. Property information is subject to change without notice. We make no guarantees regarding the accuracy or completeness of property listings.

3. Communications and Text Messaging

By providing your phone number and consenting via our contact or inquiry forms, you agree to receive communications from Big Valley Properties, which may include:

  • Transactional messages: Appointment confirmations, reminders, and account-related notifications.
  • Marketing messages (if separately consented): Property updates, special offers, and promotional content.

You may opt out of text messages at any time by replying STOP. For help, reply HELP or contact us at info@bvptrinity.com. Message & data rates may apply. Message frequency may vary.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services.

4. Artificial Intelligence (AI) Use Policy

The following guidelines govern the Company's use of Artificial Intelligence (AI) tools:

  1. Legitimate Business Purposes: AI tools may be used only for legitimate business purposes that are consistent with Company policies, applicable laws, and the REALTOR® Code of Ethics.
  2. Approved Tools & High-Risk Applications: Only Company-approved AI tools may be used in connection with Company business activities. The Company Manager shall maintain a list of approved AI tools. Legal review and management approval are required before deploying AI in high-risk applications, including consumer-facing chatbots, automated marketing campaigns, property valuation tools, transaction document preparation, and any system that processes client financial information.
  3. Confidentiality & Data Protection: No client information, financial data, transaction records, personally identifiable information, or other sensitive or confidential information may be entered into an AI system without prior approval from the Company Manager. Any third-party AI platform must be governed by contractual terms that expressly prohibit the vendor from using Company or client data to train, improve, or develop its AI models.
  4. MLS Rules & Data Integrity: AI tools may not be used to scrape, redistribute, aggregate, or repurpose MLS data in violation of MLS rules, licensing agreements, copyright restrictions, or data-sharing policies.
  5. Human Review Requirements: Associates and staff must review any AI-generated content before it is:
    • Published or distributed.
    • Sent to a client, customer, or member of the public.
    • Used in advertising or marketing materials.
    • Included in transaction documents, disclosures, or communications; or
    • Relied upon in the preparation of a Comparative Market Analysis (CMA), Broker Price Opinion (BPO), or property valuation.
  6. Licensing & Professional Limitations: AI systems may not independently perform activities that require a real estate license, establish agency relationships, negotiate transactions, provide legal advice, or create, imply, or modify legal obligations on behalf of the Company.
  7. Fair Housing Compliance: All AI-generated listing descriptions, advertisements, and marketing materials must comply with federal, state, and local fair housing laws. Associates shall not rely on AI-generated content describing neighborhoods, schools, demographics, crime rates, cultural characteristics, or other community attributes without careful human review to identify and eliminate potential bias, discriminatory language, or steering concerns.
  8. Disclosure of AI Media & Virtual Staging: The use of AI to generate images, videos, or virtual staging must be disclosed when the AI materially alters a property's appearance, in accordance with California Business and Professions Code § 10140.8 and applicable MLS rules.
  9. Consumer-Facing Chatbots & Virtual Assistants: AI-powered chatbots and virtual assistants used on Company websites, social media platforms, messaging applications, or other consumer-facing channels must:
    • Clearly disclose that the user is interacting with an AI system.
    • Refrain from providing legal advice, financial advice, lending recommendations, or property valuations.
    • Be configured to transfer inquiries to a licensed real estate professional when discussions involve transaction-specific questions, pricing, negotiations, agency relationships, contracts, disclosures, or other matters requiring professional judgment.

Incident Reporting & Corrective Action: Any suspected misuse of AI, unauthorized disclosure of confidential information, fair housing concern, inaccurate AI-generated content, cybersecurity issue, or other AI-related incident must be reported immediately to the Company Manager or designated supervisor. The Company shall promptly investigate reported incidents and implement corrective actions as appropriate. Violations of this policy may result in mandatory retraining, suspension or revocation of AI tool access, disciplinary action up to and including termination of employment or an independent contractor relationship, referral to legal counsel, and/or reporting to applicable regulatory authorities when required by law.

Supervision & Annual Training: The Company Manager or designated supervisor is responsible for ensuring compliance with this policy by all Associates and staff under their supervision. All Associates and staff shall complete AI-related training at least annually. Such training should address acceptable use of AI tools, data privacy and security, fair housing compliance, advertising and disclosure requirements, risk management, and incident reporting procedures.

5. Intellectual Property

All content on this Site — including text, images, logos, and design — is the property of Big Valley Properties or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from the Site without our express written permission.

6. Third-Party Links

The Site may contain links to third-party websites. These links are provided for convenience only. Big Valley Properties has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites.

7. Disclaimer of Warranties

The Site and its content are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Big Valley Properties does not warrant that the Site will be uninterrupted, error-free, or free of viruses.

8. Limitation of Liability

To the fullest extent permitted by law, Big Valley Properties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or its content, even if advised of the possibility of such damages.

You agree to indemnify and hold harmless Big Valley Properties, its agents, employees, and affiliates from any claims, liabilities, damages, or expenses (including attorney fees) arising from your use of the Site or violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Trinity County, California.

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of the Site following any changes constitutes acceptance of the updated Terms.
